2. Description of Service

DayTrade AI is an AI-powered trading analysis platform that provides:

• Symbol Lookup: Type any US stock symbol to receive AI-generated analysis based on real-time market data
• Screen Capture: Share your trading platform screen for AI analysis of your specific chart setup, indicators, and patterns
• AI Trading Analysis: Technical analysis including support/resistance levels, pattern recognition, entry/exit points, and risk management guidance powered by ChatGPT
• Text-to-Speech: Audio playback of analysis reports

3. Account Registration and Responsibilities

To use DayTrade AI, you must:

• Sign in using a valid Google account
• Be at least 18 years of age
• Provide accurate and complete information
• Keep your account credentials secure
• Be responsible for all activity that occurs under your account
• Notify us immediately of any unauthorized use of your account

4. Subscription Plans and Billing

DayTrade AI offers the following subscription plans:

• Free ($0/month): 3 AI analyses per month with access to all core features
• Starter ($8/month): 50 AI analyses per month with advanced chart analysis and priority support
• Pro ($20/month): Unlimited AI analyses with all premium features

Billing terms:

• Paid subscriptions are billed monthly through Stripe
• Your subscription automatically renews each billing period unless canceled
• You may cancel your subscription at any time from your account settings
• After cancellation, you retain access to paid features until the end of your current billing period
• No refunds are provided for partial billing periods
• We reserve the right to change pricing with 30 days notice to existing subscribers
• Analysis counts reset at the beginning of each billing period

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse engineer, decompile, or disassemble the Service
• Share your account with others or allow multiple users on a single account
• Use automated tools (bots, scrapers) to access the Service beyond its intended use
• Redistribute, resell, or commercially exploit AI analysis generated by the Service
• Attempt to circumvent subscription limits or security measures
• Interfere with or disrupt the Service or its infrastructure

6. Intellectual Property

The DayTrade AI platform, including its design, code, logos, and branding, is the intellectual property of DayTrade AI. AI-generated analysis provided to you is licensed for your personal, non-commercial use. You may not reproduce, distribute, or commercially exploit the platform or its outputs without written permission.

To the maximum extent permitted by law:

• DayTrade AI is provided "as is" and "as available" without warranties of any kind, express or implied
• We do not warrant that the Service will be uninterrupted, error-free, or secure
• We are not liable for any trading losses, financial losses, or damages arising from your use of the Service
• Our total liability to you for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim
• We are not liable for any indirect, incidental, special, consequential, or punitive damages

You agree to indemnify and hold harmless DayTrade AI, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these terms, or your violation of any rights of a third party.

We may suspend or terminate your account if:

• You violate these Terms & Conditions
• You engage in abusive or fraudulent behavior
• We are required to do so by law
• We discontinue the Service (with reasonable notice)

You may terminate your account at any time by canceling your subscription and requesting account deletion.

11. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of the United States. Any disputes arising from these terms or the Service shall be resolved through binding arbitration in accordance with applicable arbitration rules, except where prohibited by law.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

13. Changes to Terms

We reserve the right to modify these Terms & Conditions at any time. We will notify users of material changes by posting the updated terms on this page with a revised "Last updated" date. Your continued use of DayTrade AI after changes are posted constitutes acceptance of the updated terms.
